Terms of Service

Basic Breach Check — $30  ·  Effective 6 April 2026

1. About These Terms

These terms apply when you purchase a Basic Breach Check from CyberSurf. By placing an order and making payment, you agree to these terms in full.

These terms do not limit any rights you have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)). If there is any inconsistency between these terms and the ACL, the ACL prevails.

2. What the Service Is

The Basic Breach Check is a one-off credential exposure report. You provide your full name, phone number, and up to two (2) email addresses. We query third-party breach databases to identify whether your email addresses, usernames, or credentials appear in known data breaches, then deliver a report via a secure pCloud link.

By placing an order, you explicitly consent to receiving a report that may contain exposed passwords and other credential data associated with your email addresses.

3. Your Eligibility and Warranties

By placing an order, you confirm that:

  1. you are at least 18 years old;
  2. you are the authorised account holder for every email address you submit — the account belongs to you, you control it, and you have the right to receive a credential-exposure report for it;
  3. you are not submitting anyone else's email address without their explicit, informed written consent;
  4. you will use the report only to protect your own online accounts and credentials; and
  5. all information you provide is accurate and complete.

We do not verify account ownership. If you make a false declaration, you bear sole legal responsibility for that and we may void your report without refund.

4. What the Report Is Not

Absence from results does not mean your credentials are safe. Breach databases are incomplete. A nil result means we found no match at the time of your order — not that your credentials have never been exposed.

The Basic Breach Check is not a security audit, ongoing monitoring service, guarantee of credential safety, or legal or IT security advice.

5. Report Delivery — Secure Link

We deliver your report via a secure pCloud link sent to your nominated email or phone number.

  1. The link expires in 72 hours. Download your report before it expires.
  2. The link is for your use only. Do not forward or share it.
  3. We cannot re-send expired links — we may issue a replacement at our discretion but are not obliged to.
  4. Delivery is complete when we send the link, not when you open it.

6. Zero Data Retention

  1. We do not retain breach data. All passwords, hashed credentials, and breach records are permanently deleted after your report is delivered.
  2. We retain your order record (name, contact details, emails checked, date, payment confirmation) for the minimum period required by law — generally 5 years — then securely delete it.
  3. Your personal information is handled under our Privacy Policy and the Australian Privacy Principles.

7. Authorised Use Only

Your report is for your personal use only. You must not:

  1. share, forward, publish, or distribute the report to any other person;
  2. use it on behalf of or in relation to any third party;
  3. use it for any commercial purpose; or
  4. use any information in it to access, compromise, or interfere with any computer system or account — this may constitute a criminal offence under the Criminal Code Act 1995 (Cth).

8. Our Liability to You

8.1 Consumer Guarantees

Nothing excludes your rights under the ACL. Where ACL guarantees apply, our liability is limited (to the extent the ACL allows) to re-supplying the service or paying the cost of re-supply.

8.2 Liability Cap

Subject to clause 8.1, CyberSurf's total liability for any claim is limited to $30.00 AUD — the amount you paid.

8.3 Exclusion of Consequential Loss

Subject to clause 8.1, CyberSurf is not liable for loss of data, revenue, profits, business opportunity, or any indirect or consequential loss.

8.4 Third-Party Data

Our report reflects third-party breach database content. We make no representation about its completeness or accuracy and are not liable for errors in that data.

9. Your Responsibility

If your report shows exposed credentials, change affected passwords immediately, enable two-factor authentication, and check for password reuse. CyberSurf does not take any action on your accounts.

10. Payment

Payment is $30.00 AUD (GST inclusive where applicable), required in full at time of order. We use Stripe to process payments and do not store your card details.

11. Refunds

  1. Before we start: Full refund available.
  2. After delivery: Non-refundable once the pCloud link is sent, except where the ACL requires otherwise.
  3. If we can't complete your check: Full refund within 5 business days.

12. Changes to These Terms

Updated terms apply to orders placed after publication. We will not change terms that apply to an order you have already placed.

13. Governing Law

These terms are governed by the law of Queensland, Australia. Disputes are subject to the non-exclusive jurisdiction of Queensland courts.
